The Board of City Commissioners of the City of Shawnee, County of Pottawatomie, State of Oklahoma, met in Regular Session in the Commission Chambers at City Hall, 9th and Broadway, Shawnee, Oklahoma, Monday, April 19, 2004 at 7:00 p.m., pursuant to notice duly posted as prescribed by law. Mayor Harden declared a public hearing in session to consider an ordinance to rezone property located 4900 North Harrison for the sale of beer and alcohol for on-premises consumption (City Lights).

AGENDA ITEM NO. 8: Consider an ordinance de-annexing property located at the corner of Benson Park Road and Harrison. (Applicant: Rodney & Julie McPhetridge)
Community Development Director Mike Southard reported that the Annexation Committee recommended de-annexing the property located on the Northeast corner of Benson Park and Harrison. This tract is the only property along Benson Park that is in the city limits and is served by few city services. It is served by the rural water district.
Ordinance No. 2152 was introduced and the title read aloud.
Ordinance No. 2152NS entitled “An ordinance de-annexing certain territory and property from the present city limits of the City of Shawnee, Oklahoma, pursuant to Title 11 of the Oklahoma Statutes; describing said property; repealing all portions of ordinances in conflict herewith; and declaring an emergency.”

AGENDA ITEM NO. 9: Consider request of Travis Guess for extension of time to remodel property located at 147 S. Draper.
Community Development Director Mike Southard reported that in February of 2003, the Commission granted a 90-day extension to Mr. Guess to remodel the property located at 147 South Draper. Since that time, little work had been done and the progression has been extremely slow since the nuisance began in March 2001.
Appearing before the Commission was Mr. Sherman Murray, attorney representing First United Bank, in which the bank has interest due to a mortgage being paid on the property.
Next, Mr. Travis Guess, property owner, appeared before the Commission to state his reasons for not getting the house rehabbed in a timely manner.
In discussion, there were several conditions that Mr. Guess would be required to complete in the time allowed by the Commission.
A motion was made by Commissioner Harrod, seconded by Vice Mayor Downing, to grant another extension to Mr. Guess for six (6) months with conditions that the driveway, sewer line, plumbing, and façade metal work on the house must be completed. Motion carried.

AGENDA ITEM NO. 10: Consider appeal of Jeanne Haley of Administrative Hearing Officer’s order regarding property located at 802 S. Beard.
City staff member Mike Southard reported that on February 12, 2004, Brewer & Son was ordered to obtain a building permit within 30 days on property located 802 South Beard and for all renovations to be completed by May 6, 2004. Garth Nixon represented the owner Jeanne Haley, and the Commission granted a 45-day continuance to Ms. Haley so that she could obtain a clear title after paying the back taxes on the property. Since that time, the property has continued to deteriorate and has become a hazard to the public.
Appearing was Ms. Jeanne Haley informing the Commission that she had paid the back taxes and on April 6th obtained clear title to the property. She stated that she had started clearing the property and asked for time to get a building permit to start working on the building.
A motion was made by Commissioner Harrod, seconded by Commissioner Claybrook, to grant Jeanne Haley a 45-day extension to clean up the property of trash and debris and start the process with city inspector to determine the requirements for renovation of the structure. Motion carried.

AGENDA ITEM NO. 11: Consider request of Ron and Ruth Crews to release public nuisance liens on property located at 1222 N. Market. ($3,535.00)
Mr. Ron Crews, 1224 North Market, appeared before the Commission on June 16, 2003 to request approval to release the public nuisance liens on property located at 1222 North Market in the amount of $3,535.00. Mr. Crews informed the Commission at that time, that he had been mowing the property for several years and would like to purchase the property to maintain beautification of the neighborhood.
City Planning Director Mike Southard presented the staff report noting that proper steps had been taken to demolish the burned out structure and the City’s contractor had mowed the property since that time.
It was City Attorney John Canavan’s legal opinion that the properties are not released for private use but for public or non-profit organization purposes.
A motion was then made by Commissioner Weaver, seconded by Commissioner Peterson, to deny the request of Ron and Ruth Crews to release public nuisance liens on property located at 1222 North Market. Motion carried.

AGENDA ITEM NO. 12: Consider recommendations from Community Service Contracts Review Committee regarding renewal of contracts with the following for fiscal year 2004-2005:
It was noted that due to the decline in the City’s budget, the following contracts had been reduced by ten percent (10%), except the new contract with the District Attorney’s Office and the COCAA/Central Oklahoma Transit System, which remained the same since it has been operating under budget.
a. District Attorney’s Drug Task Force
A motion was made by Commissioner Claybrook, seconded by Commissioner Weaver, to approve the recommendation to renew the contract between the City of Shawnee and the District Attorney’s Drug Task Force for fiscal year 2004-2005 in the amount of $18,000.00. Motion carried.

A motion was made by Vice Mayor Downing, seconded by Commissioner Weaver, to approve the recommendation for a new contract between the City of Shawnee and the District Attorney’s Office of the Twenty-Third Judicial District of the State of Oklahoma for fiscal year 2004-2005 in the amount of $10,000.00 for assistance in hiring a Certified Forensic Interviewer. Motion carried.

c. Central Oklahoma Community Action Agency for operation of Community Center and Municipal Auditorium
A motion was made by Commissioner Weaver, seconded by Commissioner Claybrook, to approve the recommendation to renew the contract between the City of Shawnee and the Central Oklahoma Community Action Agency for the operation of the Community Center and Municipal Auditorium for fiscal year 2004-2005 in the amount of $43,200.00. Motion carried.

It was noted that funding would come from the General Fund of $25,000 and Economic Development of $25,000.

AGENDA ITEM NO. 14: Consider an ordinance raising plumbing contractor registration fees, changing the registration date and repealing fees for journeyman/apprentice plumbers and repealing requirement for city insurance policy and labeling identification number on vehicle.
City Clerk Diana Hallock advised the Commission that the following ordinance and the next two agenda items was to bring the current ordinance up to code in accordance with the latest state statutes. She requested the Commission not to adopt the “emergency clause” to allow staff time to notify the contractors.

Ordinance No. 2153NS entitled “An ordinance relating to registration of plumbers in the City of Shawnee; amending Sections 7-396, 7-397 and 7-398, Division 2, Article VII, of Chapter 7 of the Code of the City of Shawnee; omitting the requirement for insurance policy for the City, raising fees for plumbing contractors, removing fees for journeyman plumbers and apprentice plumbers; and changing the expiration date on certificates of registrations; repealing Sections 7-399 and 7-400, Division 2, Article VII of Chapter 7 of the Code of the City of Shawnee in their entirety; providing for severability and declaring an emergency.”

A motion was made by Commissioner Claybrook, seconded by Commissioner Harrod, to accept staff’s recommendation to award the bid for the 24” water main extension to Jim Mayes Company, Norman, Oklahoma, in the amount of $432,846.50 as the lowest as best bid. Motion carried.

The Water Conservation Plan at Level 3 states: “When the lake level reaches an elevation 1,068 feet and the average daily usage exceeds 5,000,000 gallons for seven days: Residential, other than household purposes: Water usage restricted to 12:01 A.M. to 1:00 P.M. on the odd-even system with odd-numbered houses utilizing water on Tuesdays and even-numbered houses utilizing water on Thursdays during the above hours.”
He advised the Commission that staff would closely monitor the situation. The lake level is currently between 1,066 and 1,067 feet.

AGENDA ITEM NO. 20: Citizens Participation (A five minute limit per person) (A fifteen-minute limit per topic)
Under Citizens Participation, a local citizen appeared before the Commission to request the “no smoking within 25 feet of any public building” be enforced at the public library.
AGENDA ITEM NO. 21: Commissioners Comments.
Under Commissioners Comments, Commissioner Claybrook voiced concern about the hydrant flushing while under the water rationing. Chief Jerrry Bower responded that he would put on hold the flushing and testing. He also noted that this was an evaluation year for insurance purposes, but would ask the State to delay to the end of the year.
Mayor Harden urged staff not to forget Mr. Tom Smith’s request for a Veteran’s park.

There being no further business to come before the meeting, a motion was made by Vice Mayor Downing, seconded by Commissioner Claybrook, that the meeting be adjourned. Motion carried. (9:24 p.m.)
