(Applicant: Terry Thornton d/b/a Long Ears Bar and Grill) (Application to rezone was withdrawn by applicant).

14. Consider an ordinance raising plumbing contractor registration fees, changing the registration date and repealing fees for journeyman/apprentice plumbers and repealing requirement for city insurance policy and labeling identification number on vehicle.

The applicant has requested that this request be pulled from consideration. The Planning Commission took no action on this item.
4. Public hearing and consider an ordinance rezoning property located at 32703 Clearpond Road from A-1; Agricultural District to A-1P; Agricultural District with Conditional Use Permit to allow moving a mobile home on property. (Applicant: David Petricek) Pgs. 77-87
The Planning Commission unanimously recommends approval of the request for a conditional use permit to locate a manufactured house in an agricultural district. This request is in conformance with the Comprehensive plan.
5. Public hearing and consider an ordinance rezoning property located at 42404 E. Westech Road from A-1; Agricultural District to RE; Residential Estates District for the purpose of rural residential development. (Applicant: Ralph & Steve McElmurry) Pgs. 88-97
The Planning Commission unanimously recommends rezoning property from A-1 to RE, Rural Estates. The property is approximately 9 acres and the applicant wants to split the property into two separate tracts. This request conforms to the Comprehensive Plan.
6. Public hearing and consider an ordinance rezoning property located at 4900 N. Harrison from C-3; Automotive and Commercial Recreation District to C-3P; Automotive and Commercial Recreation District with Conditional Use Permit for the sale of beer and alcohol for on-premise consumption. (Applicant: Jalal Rahseparian d/b/a City Lights) Pgs. 98-110
The Planning Commission unanimously recommends approval of the Conditional Use Permit to serve alcoholic beverages in an eating establishment. This request conforms to the Comp Plan and previous conditional use permits have been granted for this establishment.
7. Public hearing and consider an ordinance rezoning property located at 31820 Ingram Road from A-1; Agricultural District to A-1P; Agricultural District with Conditional Use Permit to allow moving a mobile home on the property. (Applicant: David & Melissa Juber). Pgs. 111-121
The Planning Commission unanimously recommended approval of the Conditional Use Permit to locate a manufactured house in an agricultural district. The site exceeds the minimum area requirements. This request conforms to the Comp Plan and the Lake Master Plan.
8. Consider an ordinance de-annexing property located at the corner of Benson Park Road and Harrison. (Applicant: Rodney & Julie McPhetridge) Pgs. 122-128
The Annexation Committee unanimously recommends deannexing the property located on the Northeast corner of Benson Park and Harrison. This tract is the only property along Benson Park that is in the city limits and is served by few city services.
9. Consider request of Travis Guess for extension of time to remodel property located at 147 S. Draper. Pgs. 129-131
In February 2003, the Commission granted a 90 day extension to Mr. Guess to renovate the property. Since that time, little work has been done. The process to address this nuisance started in March 2001 and has progressed extremely slowly to the detriment of the neighborhood.
10. Consider appeal of Jeanne Haley of Administrative Hearing Officer’s order regarding property located at 802 S. Beard. Pgs. 132-138
Feb. 12, 2004, Brewer & Son was ordered to obtain a building permit within 30 days and for all renovations to be completed by May 6th. Garth Nixon represented the owner but hadn't inquired with the owner as to what they were willing to do to the property. In March, the Commission granted a 45-day continuance to Ms. Haley so that she can obtain clear title after paying the back taxes for the property. Since that time the property has continued to deteriorate and has become a hazard to the public.
11. Consider request of Ron and Ruth Crews to release public nuisance liens on property located at 1222 N. Market. ($3,535.00) Pg. 139
On June 16, 2003 Mr. Ron Crews previously appeared before the city commission to make this request. Below is an excerpt from the minutes of the June 16, 2003 meeting:
Mr. Ron Crews, 1224 N. Market, appeared before the Commission to request approval to release the public nuisance liens on property located at 1222 N. Market in the amount of $3,535.00. Mr. Crews, adjacent owner, informed the Commission that he had been mowing the property for several years and would like to purchase the property to maintain beautification of the neighborhood. The staff report was given by Community Development Director Mike Southard noting that proper steps had been taken to demolish the burned out structure and the City’s contractor had mowed the property since then. The original owner was Mr. William Shannon Beck. After a lengthy discussion, the city attorney advised that the original owner would have three years to pay and still be given the final offer to retain the property. A motion was made by Commissioner Weaver, seconded by Commissioner Harrod, to deny the request from Mr. Ron Crews to waive the public nuisance lien on the 1222 N. Market property. Motion carried. AYE: Weaver, Harrod, Harden, Peterson, Downing, Claybrook, Pettyjohn
