The Planning Commission of the City of Shawnee, County of Pottawatomie, State of Oklahoma, met in Commission Chambers, at City Hall, 9th and Broadway, on Wednesday, January 7, 2009 at 1:30 p.m., pursuant to notice duly posted as prescribed by law.
AGENDA ITEM NO. 1: Roll Call
Upon roll call the following members were present:
John Holt
Louis Maltos Kirk Hoster
Shawna Turner
Absent: Jimmy Nickles and Brad Carter
A quorum was declared present and the meeting was called to order.
Note: Jimmy Nickles arrived at 1:32 p.m. and Brad Carter arrived at 1:35 p.m. during Agenda Item # 4
AGENDA ITEM NO. 2: Approval of the minutes from the December 3, 2008 Planning Commission Meeting.
Chairman Holt asked for a motion, Commissioner Hoster made a motion, seconded by Commissioner Turner to approve the December 3, 2008 Planning Commission Meeting minutes.
Motion carried:
AYE: Hoster, Turner, Holt, and Maltos
NAY: None
ABSTAIN: None
AGENDA ITEM NO. 3: Swear in Chris Silvia to the Planning Commission.
Chris Silvia was sworn in to the Planning Commission by Karen Drain.
AGENDA ITEM NO. 4: Case #P01-09 - A public hearing for consideration of approval to rezone property from RE; Rural Estates to C-3; Automotive, Commercial & Recreation for property located at 39206 W. MacArthur (Applicant: Brian Mahaffey)
Brian Mahaffey was present for the meeting.
Chairman Holt asked for the Staff Report. Justin Erickson summarized the staff report.
The area requested for rezone is a narrow strip of land approximately 60 feet wide by 435.66 feet long. Mr. Erickson stated that rezoning the site to C-3 will facilitate expansion of the existing storage business and will form a logical border and boundary for the C-3 zoned properties in this vicinity. This property was annexed into the City of Shawnee in September of 2004 along with many other surrounding properties.
Staff recommended approval of the request to rezone 39206 W. MacArthur from RE to C-3.
Justin Erickson answered questions from the Commission.
John Holt opened the public hearing asking if anyone wanted to speak for this proposal. Brian Haffey came forwarded and explained he wanted the rezoning for future expansion.
John Holt asked if anyone wanted to speak against the proposal. John Blossom came forward with questions concerning his property across the street. His property was also annexed into the city limits. His understanding was that when the property was annexed into Shawnee city limits it could not be rezoned. John Holt explained that was a misunderstanding. The Commission answered questions from Mr. Blossom.
Chairman Holt asked for a motion, Commissioner Nickles made a motion, seconded by Commissioner Maltos to approve rezoning 39206 W. MacArthur from RE to C-3.

AYE: Nickles, Maltos, Turner, Silvia, Hoster, Carter and Holt
NAY: None
ABSTAIN: None
AGENDA ITEM NO. 5: Case # S28-08- Consideration of approval of a final plat for Sehorn Commercial Plaza located in the 2250 block of N. Harrison. (Applicant: Mark Sehorn) Deferred from the December 3, 2008 meeting.
Justin Erickson asked this item to be deferred to the February 4, 2009 meeting, still waiting on engineered plans.
Chairman Holt asked for a motion, Commissioner Maltos made a motion seconded by Commissioner Carter to defer this item to the February 4, 2009 meeting.
