BOARD OF CITY COMMISSIONERS PROCEEDINGS
SPECIAL CALLED SESSION
JANUARY 30, 2003

The Board of City Commissioners of the City of Shawnee, County of Pottawatomie, State of Oklahoma, met in Special Called Session in the Commissioner Chambers of City Hall, 9th and Broadway, Shawnee, Oklahoma, Thursday, January 30, 2003 at 4:00 p.m., pursuant to notice duly posted as prescribed by law. Mayor Harden presided and called the meeting to order. Upon roll call, the following members were in attendance.

CALL FOR SPECIAL SESSION OF THE BOARD OF COMMISSIONERS OF THE CITY OF SHAWNEE, OKLAHOMA TO BE HELD ON THE 30TH DAY OF JANUARY, 2003 AT 4:00 P.M. IN THE CITY COMMISSION CHAMBERS AT CITY HALL, 9TH AND BROADWAY, SHAWNEE, OKLAHOMA, AND SETTING FORTH THE PURPOSE OF SAID SPECIAL SESSION.

By virtue of the authority vested in me by Section 2, Article IV of the Charter of the City of Shawnee, Oklahoma, a Special Session of the Board of Commissioners of the City of Shawnee, Oklahoma is hereby called to meet in the City Commission Chambers, City Hall, 9th and Broadway, Shawnee, Oklahoma at 4:00 p.m. on January 30, 2003 for the purpose of considering a resolution supporting tax credit award for housing development project proposed by Farnam Group Resources, Inc. and a resolution supporting tax credit award for Aldridge Hotel project proposed by ERC Properties, Inc.

TO THE BOARD OF COMMISSIONERS OF THE CITY OF SHAWNEE, OKLAHOMA AND THE CITY MANAGER:

You and each of you are hereby notified that by virtue of a call issued by me on this 28th day of January, 2003, a Special Session will be held of the Board of Commissioners of the City of Shawnee, Oklahoma in the Commission Chambers of City Hall, 9th and Broadway, Shawnee, Oklahoma at 4:00 p.m. on January 30, 2003, and you are hereby notified to be present at said meeting.

The purpose of said meeting is to consider a resolution supporting tax credit award for housing development project proposed by Farnam Group Resources, Inc. and a resolution supporting tax credit award for Aldridge Hotel project proposed by ERC Properties, Inc.

AGENDA ITEM NO. 1: Consider a resolution supporting tax credit award for housing development project proposed by Farnam Group Resources, Inc.

In consideration of the resolution of support for tax credit award for housing development project proposed by Farnam Group Resources, Inc., Omaha, Nebraska, Commissioner Claybrook made a motion to amend the resolution “supporting favorable consideration be given for tax credit award for project for the tax cycle commencing in July 2003.” The motion was seconded by Commissioner Weaver for discussion purposes.
In discussion, Commissioner Claybrook justified his motion indicating that he was not opposed to the 54-unit housing development, but rather the timing of the application was in conflict with the Aldridge renovation tax credit application deadline for February 1, 2003, which has been put on hold for sometime by the Oklahoma Housing Finance Authority.
Also, Commissioner Weaver took a similar position by seconding the motion to approve the resolution based on requests from BancFirst, the financial institute for the Aldridge application, noting that pressure had been mounting to have Aldridge as the sole applicant for this tax credit cycle.
Commissioner Weaver indicated that he supported the location of Farnam’s proposed housing units and he encouraged its development.
Before making comments, Commissioner Harrod clarified with the city attorney his position regarding a lawsuit he and his wife, Kaye Steele Harrod, and all other persons similarly situated, had filed in District Court earlier this same date, filing an injunction against the Board of City Commissioners regarding their decision on January 21, 2003 granting the rezoning for Farnam Resources, Inc. (on property near Commissioner Harrod’s residence); and to restrain them from further action to enforce the rezoning decision until further order from the Court.
City Attorney John Canavan advised that the lawsuit did not have an effect on this meeting.
Therefore, Commissioner Harrod gave his opinion about Farnam’s finances and he was adamantly opposed to the housing development stressing that Farnam overpriced its development and the information that Farnam was not Section 8 housing was misleading.
Mayor Harden asked the representative for Farnam Group Resources, Inc. to address the Commission.
Mr. James Hamlin, Chief Operating Officer of Farnam Resources, Inc. addressed the Commission stating that in light of the motion made, it was unexpected and he could not respond at this time and would need to consult with his partners.
He did comment that the two projects were totally different, the Aldridge for senior citizens and the Farnam development as family units, which he saw no reason why both projects could not proceed.
Mr. Hamlin relayed that his company had conducted research on the housing needs for Pottawatomie County, and through the Oklahoma Housing Finance Authority’s publication of 2001, there was a need for 205 units in Pottawatomie County.
Concluding discussion, the following resolution was presented as amended.


Resolution No. 6162 was introduced and the title read aloud.

Resolution No. 6162 entitled “A resolution supporting the construction of a (54) fifty-four unit housing development located within the corporate limits of the City of Shawnee, Oklahoma; supporting favorable consideration be given for tax credit award for project for the tax cycle commencing in July, 2003; and finding that the proposed development is consistent with the City’s affordable housing strategies.”

A motion was made by Commissioner Claybrook, seconded by Commissioner Weaver, to approve the amended Resolution No. 6162. Motion carried.

AGENDA ITEM NO. 2: Consider a resolution supporting tax credit award for Aldridge Hotel project proposed by ERC Properties, Inc.

Resolution No. 6161 was introduced and the title read aloud.

Resolution No. 6161 entitled “A resolution in support of the renovation of the historic Aldridge Hotel building for mixed use as a retail/office/elderly housing development containing up to 61 tax credit apartment units; and supporting favorable consideration given for tax credit award for project.”

A motion was made by Commissioner Harrod, seconded by Commissioner Weaver, that the Title and Resolution be approved. Motion carried. Motion carried.
AYE: Harrod, Weaver, Peterson, Downing, Claybrook, Pettyjohn, Harden
NAY: None

AGENDA ITEM NO. 3: Adjournment.
There being no other business to come before the meeting, a motion was made by Commissioner Pettyjohn, seconded by Vice Mayor Downing, that the meeting be adjourned. Motion carried. (4:20 p.m.)
