Harrison from C-3; Automotive and Commercial Recreation District to C-3P; Automotive and Commercial Recreation District with Conditional Use Permit for use as a veterinary clinic with outdoor runs. The Planning Commission unanimously recommend approving a conditional use permit to operate a vet clinic with outdoor runs with the following conditions: a sight proof fence be erected on the north and east side of the dog runs, individual drains be constructed in each run to minimize smell, no more than 12 runs are allowed, and that the animals be placed indoor after 9:00 PM. This request conforms to the Future Land Use Map and the Comp Plan. The City Clerk’s Office has received a complaint regarding this rezoning.

6. Public hearing and consider an ordinance to rezone property located at 227 S. Philadelphia from R-2; Combined Residential District and I-2; Light Industrial District to C-4; Central Business District for use as an automobile body repair and office/warehouse. (Applicant: David James) Pgs. 65-75

The Planning Commission recommends rezoning the property from I-2 and R-2 to C-4, Central Business District. This property is completely developed and abuts residential properties. This request conforms to the Comp Plan.

7. Public hearing and consider an ordinance to rezone property located at 901 – 903 N. Minnesota Street from R-1; Single Family Residential District to R-2; Combined Residential District for the purpose of building duplex housing. (Applicant: Westchester Development) Pgs. 76-90

The Planning Commission recommends rezoning property from R-1 to R-2. The Comp Plan recommends allowing duplex housing for infill development and affordable housing. This property exceeds the minimum area requirements for R-2.

The Planning Commission recommends rezoning property from R-1 to R-2. The Comp Plan recommends allowing duplex housing for infill development and affordable housing. This property exceeds the minimum area requirements for R-2. The City Clerk’s Office has received complaints regarding this rezoning.



9. Public hearing and consider an ordinance to rezone property located at 1020 E. Highland from C-1; Neighborhood Commercial District to C-3; Automotive and Commercial Recreation District for use as retail automotive sales. (Applicants: Daniel L. and Lisa G. Moody) Pgs. 102-114

The Planning Commission recommends rezoning from C-1 to C-3. This request conforms to the Future Land Use map and the Comp Plan.

10. Public hearing and consider an ordinance to rezone property located north of SH-177 and east of Acme Road from A-1; Agricultural District to I-2; Light Industrial District for use as light manufacturing. (Applicant: City of Shawnee) Pgs. 115-122

The Planning Commission recommends rezoning the properties annexed in December from A-1 to I-2, Light Industrial. Staff has reviewed all uses in this area and concluded that I-2 is the most appropriate classification. Due to the close proximity to the residential properties to the North and East, staff discourages I-3 (heavy industrial). This zoning complies with the Comp Plan and the Future Land Use Map.

11. Public hearing and consider an ordinance changing the area and frontage requirements for duplex type developments. (Applicant: City of Shawnee) Pgs. 123-130

The Planning Commission recommends adopting the ordinance to change the area and width requirements for duplex housing. These changes will promote residential development on infill lots. Three 25’ lots could be combined developed as a duplex structure if rezoning allows.

12. Public hearing and consider an ordinance amending the City Code regarding advertising and signs. (Deferred from 2/2/04) Pgs. 131-134

The Beautification Committee recommends approval of the sign codes to allow for electronic message signs for on-site and off-site advertisements. On-site electronic advertisements must be integrated into the business sign and allowed in higher intensity commercial districts. Off-site electronic advertising would be limited to the Interstate corridor as a conditional use in commercial districts and the sign is regulated in design and content. A list of the recommended restrictions for both signs is provided in the ordinance.

13. Consider contract between City and Intervest Development Limited Partnership, re: sidewalk repairs, easements and reimbursement. Pgs. 135-142

14. Consider the appeal of Frank Jones regarding the Administrative Hearing Officer’s decision to remove the sign from property located at 404 S. Beard. Pgs. 143-147

There is an old sign located on the property at 404 S. Beard. The lot was used as a car dealership but the sign was never used. The property owners Alverdia Jones and Judy Phillips were notified in writing of the public hearing on 12-18-03. No one contacted the Action Center to discuss the sign nor did anyone show up at the hearing. The administrative order was to raze and remove the sign by January 1st. Since no action was ever taken, staff took bids and awarded the demolition to Randy’s Signs in the amount of $160 on January 20, 2004.
