f. Approve request to submit application for funding to the Oklahoma Housing Finance Agency for the FY 2004 HOME Investment Partnership Program; Owner-Occupied Rehabilitation Program.

Shawnee has received over $400,000 in home funds over the last 3 years. We approximate that this grant will rehabilitate 5 owner occupied houses. If awarded, the funds will be available by July 1st. Our 25% match requirement is waived through September 30th due to a FEMA disaster designation, but Shawnee has banked approximately $350,000 for this and future home grants. Staff plans to apply for another grant of $150,000 in the next cycle to build houses on infill lots.

(Applicant: Michael and Shelly Davis) (Deferred from 3/15/04) Pgs. 54-62

The Planning Commission unanimously recommends denial of the Conditional Use Permit to locate a manufactured house in the A-1, Agricultural district. The denial was recommended due to the fact that the general contractor failed to obtain all necessary permits and inspections and to submit a DEQ septic tank report. All requirements have been completed since the Planning Commission meeting.

4. Public hearing and consider an ordinance to rezone property located at 31820 Ingram Road from A-1; Agricultural District to A-1P; Agricultural District with Conditional Use Permit to allow move in of a residential mobile home. (Applicant: Chris Kovach) (Deferred from 3/15/04) Pgs. 63-71

The Planning Commission unanimously recommends approval of a conditional use permit to locate a manufactured home in the A-1, Agricultural district. The lot has been cleared and is ready for construction. A permit must be obtained prior to construction starting.

5. Consider acceptance of improvements in Woodsong Addition and placing maintenance bonds into effect.

The developer of Woodsong Addition, Section One has completed the installation of all public utilities and the drainage improvements. All necessary bonds have been delivered to the staff and are acceptable. Staff recommends accepting the improvements.

6. Consider entering into an Agreement with Pottawatomie County and the Sac & Fox Nation to cause Brangus Road from Independence to MacArthur to be improved with asphalt paving. Pgs.72-73

Brangus Road from Independence to MacArthur Street is a mile long gravel road that 3/8's of the road right-of-way is in the City limits and 5/8's is in the County, and the entire road length lies within the boundaries of the Sac & Fox Nation. Preliminary discussions have been held with the City, County, and Sac & Fox as to maybe pooling resources of the three in order to get Brangus Road paved with asphalt surfacing. The County would grade, widen and align the roadway where needed and stabilize the base in preparation for asphalt surfacing. The City would install the asphalt pavement with the City's own equipment and manpower, and the Sac & Fox Nation would provide the funding to purchase the asphalt materials.
