The Planning Commission continued this item until their January 4th meeting, so it must be continued by the City Commission until the second meeting in January.

7. Public hearing and consider an ordinance rezoning Lots 1, 2 and 3, Block 2 of the Orchard Addition located at Bradley and Center streets from R-1; Residential District to R1-Z; Zero Lot Line Residential District. (Applicant: Shared Funding LLC). Pgs. 76-88

The Planning Commission unanimously recommends approval of the rezoning from R-1 to R-1Z. The purpose of the rezoning is to place four houses on three lots. The lot size is consistent with the residential lots to the south (Thompson Addition) and request conforms to the Comprehensive Plan.

8. Public hearing and consider an ordinance rezoning property located at 33403 Lake Road from A-1; Agricultural District to A-1P; Agricultural District with Conditional Use Permit to allow for manufactured home at this location. (Applicants: Charles and Lynette Davis). Pgs. 89-98

The Planning Commission recommends approval of the Conditional Use Permit to place a manufactured home in the A-1 district subject to conditions being met. The general conditions consist of the date of construction, dual sectional, pitched roof, specific foundation, and front & rear porches. These requirements will make the structure more permanent and compatible with the area.

9. Public hearing and consider an ordinance rezoning property located on Lake Road west of Leo Street from A-1; Agriculture District to A-1P Agricultural District with Conditional Use Permit to allow for manufactured home at this location. (Applicant: Lonnie D. Hawkins). Pgs. 99-114

The Planning Commission recommends approval of the rezoning from R-1 to C-1. The request conforms to the Comprehensive Plan.

12. Consider approval of final plat for Shawnee Mission Plaza Section 7 located east of Kickapoo Street and south of Interstate 40. (Applicant: Intervest Development LP). Pgs. 137-139

This is a two-lot subdivision located on Kickapoo. The water line will be extended from Sonic to Braums, looping the line on the east side of the street. No additional driveways will be constructed on Kickapoo, but an entryway immediately south of these lots will be constructed to serve all the property behind the existing commercial properties.

13. Consider approval of amended final plat of Windmill Ridge Office Complex located north of Independence Street and east of Bryan Street. (Applicant: Windmill Development LLC). Pgs. 140-142

The Planning Commission recommends approval of the revised Final Plat. The only difference between the previous plat and this revision is the elimination of a portion of the common area. No utilities will be relocated or extended.

14. Discuss and consider lake lease, Lot 5 Bodkin Tract, leased by Lahoma Gallagher. (Continued from November 21, 2005) Pgs. 143-145

Staff has attempted to work with the leaseholder since 1999 to address the septic tank requirement. As a result, no lease has been renewed since that time. Nothing official is available showing where the septic tank and lateral lines are located. City Code requires that they be located further than 150 feet of the high water mark, but the memo from DEQ states that they are located approximately 70 feet. City Code also requires a minimum of 400 feet of lateral lines where state codes are based on occupancy. DEQ cannot assure the City that state and city regulations have been met. Staff recommends that the leaseholder be given 30 to 60 days to install a new septic system and provide staff with the DEQ inspection report as per code. If this is not accomplished, then the lease should be revoked.

15. Consider final Comprehensive Annual Financial Report for FY 04-05. (To be distributed)

Two Commissioners are needed to review the submittals by consulting firms for the Land Development Code and the Dunbar Heights Neighborhood Action Plan. Each review committee will have a Commissioner along with a planning commissioner, citizen and staff. The submittals are due on December 21st and a short-list of interviewing firms will be prepared in January. Interviews could occur in February.

20. Discuss and consider the relocation of the Farmer’s Market shelter.
